New trial ordered into gang hit

EDMONTON — The Alberta Court of Appeal has ordered a new trial for a man convicted of first-degree murder in a gang-related slaying.

Christopher Fleig was found guilty of orchestrating the shooting death of Brandon Prevey in April 2009.

Prevey, who was a well-known criminal in Edmonton and Red Deer, was hit by seven of fifteen rounds that peppered a car he was in on a Red Deer street.

The Crown argued that Fleig gave the murder weapon to the shooter and instructed him to kill Prevey.

Fleig admitted in court he heard the shots being fired but denied being part of the killing.

In his appeal, Fleig argued the trial judge made mistakes in law and misconstrued key evidence.
