Rogers can’t claim speed title: court

Bell Aliant has won another round in its legal battle against claims by Rogers Communications Inc. that it has the fastest and most reliable Internet offering.

FREDERICTON — Bell Aliant has won another round in its legal battle against claims by Rogers Communications Inc. that it has the fastest and most reliable Internet offering.

The New Brunswick Court of Appeal on Tuesday upheld an injunction granted last month to to prevent Toronto-based Rogers from making the claim.

In her May 4 ruling, Justice Judy Clendening of the Court of Queen’s Bench in Fredericton ordered Rogers to stop claiming to have the “fastest speed,” “most reliable speed,” or “fastest and most reliable speed.”

Bell Aliant’s lawyers argued the research that Rogers used to make its claim wasn’t fair because it couldn’t be certain how many of Bell Aliant’s new fibre-to-the- premises, or FTTP, customers were included in the study that compared the two company’s Internet services.
