A Red Deer judge has decided a caregiver charged with sexually assaulting a severely disabled man will stand trial in Court of Queen’s Bench.

Leo Denis Ducharme, 58, of Red Deer, is charged with one count of sexual assault and returns to court on Feb. 6 in Court of Queen’s Bench to enter a plea or set a trial date.

Ducharme is in custody following three counts of breaching the conditions of his release in Calgary.

Ducharme was previously released on $1,000 bail and was ordered not to have any contact with the alleged victim and stay five blocks from his house. Other restrictions included staying away from people with disabilities or those under 18 without an adult or guardian present, avoiding areas where children are typically present, like schools and playgrounds, and he is not allowed to possess a computer.

A preliminary hearing wrapped up on Tuesday in Red Deer provincial court and Judge Gordon Deck determined there was enough evidence to warrant Ducharme stand trial.

It was alleged earlier by RCMP that the mother of the disabled man came home about 10 a.m. on Aug. 9, 2010, to find her 29-year-old son being sexually assaulted.
