Postponement granted in attempted murder trial

Tibor Frank Smode, 45, of Red Deer, was to have a two-day Court of Queen’s Bench trial before a judge sitting alone when Crown prosecutor Charlotte Oxford asked for the adjournment.

Justice John Gill of Edmonton granted the request and heard that a new trial date has been set for Sept. 29.

Smode faces charges of attempted murder, aggravated assault, forcible confinement and uttering threats in an Aug. 23, 2010, incident at a Red Deer residence.

RCMP were called to a residence near 39th Street and 50th Avenue in Red Deer at about 8:50 p.m. as the result of reports of an assault.

Police allege that a man held his common-law wife against her will, bound, smothered and threatened her. She was eventually able to run to a neighbouring residence and call police.

The woman did not require hospital treatment.

Smode has been in custody since his arrest.

His lawyer Lorne Goddard told court he will make an attempt later this week to have him released on bail while awaiting trial.
