Crown files appeal in case of mother who killed teenage daughter

CALGARY — The Crown is appealing the three-year probation sentence handed to a Calgary woman who killed her teenage daughter.

CALGARY — The Crown is appealing the three-year probation sentence handed to a Calgary woman who killed her teenage daughter.

Aset Magomadova strangled 14-year-old Aminat Magomadova with a head scarf in their home in February of 2007.

The Crown filed notice to the Court of Appeal that it will argue the sentence was not proportional to the gravity of the offence and the culpability of the offender.

In the notice, the Crown says the sentence doesn’t adequately deal with deterrence, denunciation and retribution.

In his decision, the judge said putting Magomadova in prison would be more like vengeance.

He had previously found her guilty of manslaughter rather than second-degree murder in the killing.

The mother and daughter, who were originally from Chechnya, had gotten into a fight over the girl’s rebellious behaviour.

Magomadova contended the girl attacked her with a knife and that’s when she strangled her.

However, court was also told it would have taken up to five minutes for the girl to die from strangulation.
