Man receives probation in sexual peeping incident

A drug addict who thought he could trade kiddie porn for crack received a sentence of two years probation Friday for trying to take dirty pictures of a young girl.

CALGARY — A drug addict who thought he could trade kiddie porn for crack received a sentence of two years probation Friday for trying to take dirty pictures of a young girl.

Provincial court Judge Terry Semenuk accepted a joint Crown and defence submission that probation was appropriate because the jail time the offender, Hector Gerardo Santos, has already served was sufficient.

Semenuk agreed Santos’ crime did not involve aggravating factors which would usually result in sentences in the four-year range for sex attacks on children.

“The offence was not a serious or major sexual assault and the accused was not in a position of trust,” said Semenuk during sentencing.

“This was a case of momentary touching and voyeurism.”

Santos, 38, who earlier pleaded guilty to sexual interference, served close to eight months while awaiting sentencing, the judge said.

The judge also noted that Santos regretted his conduct.

A condition of his probation is that he undergo assessment and any recommended treatment for alcohol and drug abuse.
