Murder hearing delayed

A Rocky Mountain House man charged with second-degree murder will have to wait another two weeks to learn whether the Crown wants to conduct a preliminary hearing.

A Rocky Mountain House man charged with second-degree murder will have to wait another two weeks to learn whether the Crown wants to conduct a preliminary hearing.

Michael Thivierge, 54, returns to court on Aug. 10 to enter a plea on the murder charge stemming from the May 18 stabbing death of Chester Shearer, 64, of the Rocky area.

Defence lawyer Lorne Goddard was handed more disclosure on the incident from Crown prosecutor Denis Huot.

Huot told court he also needed more time to decide whether he would conduct a preliminary.

Thivierge was originally charged with manslaughter but that was upgraded to second-degree murder about a month ago when the Crown received new information.

Thivierge, who remains in custody, appeared on closed circuit TV.

A preliminary hearing is held when the Crown agrees with the defence that one is necessary. They are held to determine if there’s enough evidence to warrant the accused stand trial in Red Deer Court of Queen’s Bench.
