A Red Deer man charged with murder in the death of an 18-month-old baby last October has elected to go to trial.

A Red Deer man charged with murder in the death of an 18-month-old baby last October has elected to go to trial.

Evan Caswell Gilmer, 30, is charged with second-degree murder in the death of Garth Leippi.

Gilmer’s lawyer Lorne Goddard told the court his client has elected a judge and jury trial.

Gilmer remains in custody and returns to court on Aug. 5 to set a date for a preliminary inquiry.

A preliminary is held to determine if there’s enough evidence to warrant an accused be tried in Court of Queen’s Bench.

Gilmer, who was the boyfriend of the infant’s mother, was originally arrested by police last October but was not charged.

He was re-arrested and charged three weeks ago.

Leippi’s injuries occurred at a residence in the 4800 block of 46th Street.

Red Deer RCMP were called to the Red Deer hospital on Oct. 12 after the boy came in by ambulance with suspicious injuries. He was transported by STARS air ambulance to a Calgary hospital with life-threatening injuries.

He died from his injuries on Oct. 13.
